Music Mondays – Copyright Lawsuit Trend Continues With Lady Gaga

A Star Is Born earned Lady Gaga’s first Academy Award for the song, “Shallow,” but now that song has brought a new copyright lawsuit against the megastar. The trial is being brought forth by songwriter Steve Rosen that it copied a three-note progression from his 2012 song, “Almost.”

This case is another in a long list of copyright lawsuits that have the music industry on edge as professionals in the field adapt to a changing legal landscape. The list of recent songs under the scrutiny of copyright infringement includes Robin Thicke and Pharrell Williams’ song “Blurred Lines,” and Katy Perry’s song “Dark Horse.” Do these cases indicate and reshaping of legal precedents? Will they have the power to drive changes in the industry practices?

The digital age has complicated defense arguments by accused artists claiming never to have heard songs of copying. It would seem that there needs to be a new way to detect and avoid plagiarism. These suits impact everyone from the artist, songwriter, composer, publisher, and insurance agencies. We’ll keep watching this space.
