Horizon Comics Productions 2016 suit against Marvel Entertainment was brought to end this month after a Judge ruled that Horizon failed to persuade the court that Marvel had copied their character, “Caliban.” If you remember, Horizon’s argument rested on the fact that six Marvel employees working on the “Iron Man 3” poster were either aware of or had a “working relationship” with their comic book. 

U.S. district judge, J. Paul Oetken, wrote in his ruling that, “there is virtually no evidence in the record that shows any one of these individuals either would have seen the Caliban Drawing or would have been involved in the ‘Iron Man 3’ Poster design, let alone both.”Despite the “noteworthy similarities” it was Horizon that was not able to prove evidence while Marvel was able to demonstrate the poster was independently developed.
